Privacy Policy

This Online Privacy Notice (“Privacy Policy”) explains how we handle the Personal Data (as defined below) provided to us on websites, mobile sites, mobile applications, and other digital services and products controlled by OMS Women’s Leadership Initiative, 1650 Market Street, Suite 3600, Philadelphia PA 19103, that link to this Privacy Policy (collectively, “OMSWLI Sites”). OMSWLI is the data controller for the processing of Personal Data under applicable law.

This Privacy Policy does not apply to OMSWLI Sites that do not link to this Privacy Policy or to third-party websites to which OMSWLI Sites may link.

Types of Information We Collect Online
The types of Personal Data that we may collect while you use the OMSWLI Sites are described in this section and include both information that you provide to us and information that we collect automatically when you use the OMSWLI Sites.

For purposes of this Privacy Policy, “Personal Data” means information that identifies you or that could reasonably be used to identify you. Examples of Personal Data include name, address, telephone number, and email address.

Information You Provide
You do not have to register for a service or program to receive much of the information available on the OMSWLI Sites. Some of our content, however, is available only to registered or identified users and will require you to set up a profile or provide specific information about yourself in order to provide you the service.

Personal Data You Provide When Visiting the OMSWLI Sites
OMSWLI collects Personal Data that you provide on the OMSWLI Sites—for example, when creating an OMSWLI account, contacting OMSWLI directly for customer service, registering for an OMSWLI event (virtual or live), or responding to OMSWLI questionnaires or surveys. These types of information may include:

  • Contact information such as your name, address, phone number, or email address;
  • Registration information such as your username and password;
  • Employment, education, and other background information;
  • Payment information (such as banking information, payment card number, expiration date, delivery address, and billing address); or
  • Content you may provide (for example, when you complete our Online Contact Form, complete a biographical profile, or submit other information).

Personal Data You Share During Other Interactions with OMSWLI
You may contact OMSWLI at any time, for any reason. If you communicate with or request information from OMSWLI, you may be prompted to provide your contact information as well as any Personal Data that is relevant to your request.

Information That May Be Collected Automatically
When you use the OMSWLI Sites, we also may collect certain usage and device information automatically as described below.

IP Address
We may record the Internet Protocol (“IP”) address of your computer or other electronic device when you visit the OMSWLI Sites. An IP address identifies the electronic device you use to access the Sites, which allows us to maintain communication with your computer as you move about the OMSWLI Sites and customize content.

Cookies and Other Tracking Technologies
We may also collect information about your use of the OMSWLI Sites through tracking technologies such as cookies and web beacons. A “cookie” is a unique numeric code that is transferred to your computer to track your interests and preferences and to recognize you as a returning visitor. A “Web beacon” is a transparent graphic image placed on a website, e-mail, or advertisement that enables the monitoring of things such as user activity and site traffic. These technologies help remember your preferences and allow us to bring you the content and features that are likely to be of greatest interest to you on the basis of “clickstream” data that shows your previous activities on the OMSWLI Sites.

We may utilize Google Display Advertising (such as Retargeting with Google Analytics, Google Display Network Impression Reporting, DoubleClick Campaign Manager integration, and Google Analytics Demographics and Interest Reporting) to (1) show you our ads on other websites based on your prior visits to the OMSWLI Sites, and (2) better understand our ad impressions and use of ad services. In connection with the Google Analytics Demographics and Interest Reporting service, we may use data from Google’s interest-based advertising or third-party audience data (such as age, gender, and interests) with Google Analytics to understand and improve our marketing campaigns and Site content.

Some of our online advertising may take place through Google Display Advertising. As part of this program, we use Google Analytics features such as Retargeting. In connection with that feature and others offered by ad networks, we and the operators of ad networks, including Google, may use third-party cookies (such as the DoubleClick cookie) – and in some cases first-party cookies (such as the Google Analytics cookie) – to inform, optimize and serve ads across the Internet, based on a user’s past visits to the OMSWLI Sites. We also may show you ads from when you visit the OMSWLI Sites.

You can opt out of Google Ads by visiting http://www.google.com/ads/preferences. If you do not want your data used by Google Analytics, you can install the Google Analytics opt-out browser add-on at the Google Analytics opt-out page.

The OMSWLI Sites are not designed to respond to “do not track” signals received from browsers.

Mobile Tracking
The OMSWLI is also available either as mobile applications or mobile sites that you can use on your mobile device. If you use a mobile device to access and use the OMSWLI Sites, we may collect the following mobile-specific information in addition to the other information described above: device or advertising ID, device type, hardware type, media access control (“MAC”) address, international mobile equipment identity (“IMEI”), the version of your mobile operating system, the platform used to access or download the OMSWLI Sites (e.g., Apple, Google, Amazon, Windows), location information, and usage information about your device and your use of the OMSWLI Sites.

Information Collected from Other Sources
We may also combine information about you that is collected through the OMSWLI Sites with information that we have collected offline, as well as with information provided to us by third parties.

How We Use Your Information
We use your Personal Data to provide you the services you request, communicate with you, improve your experience on the OMSWLI Sites, and generally improve our services and for other internal business purposes. These uses may also include the recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction of Personal Data. The Personal Data we collect about you may be stored and/or archived for no longer than necessary for the purposes set out above, in accordance with applicable laws.

Providing Services You Request
If you choose to receive our services, we use the Personal Data that you provide through the OMSWLI Sites to process payments, to respond to your questions, provide you the services you request, and offer an optimal customer experience.

Marketing
You may also receive marketing information from OMSWLI, such as offers regarding OMSWLI-related services, invitations to participate in events, or surveys about our services. In such cases, we will use your contact and other Personal Data to send you marketing information.

Customized User Experiences
The Personal Data that you provide may be used to create customized offers, information, or services tailored to your interests and preferences. Also, we may use your IP address and the data that we obtain automatically through the use of cookies or similar tracking technologies to make the OMSWLI Sites easier to use and navigate as well as to personalize the content provided on the OMSWLI Sites by anticipating the information and services that may be of interest to you.

Business and Product Improvement
In order to discover new facts that could help OMSWLI better understand customer needs and help improve, develop, and evaluate product, services, materials, and programs, OMSWLI analyzes the information that you have provided. For these purposes OMSWLI does not use information that can directly identify you.

Site Analytics and Improvement
We may use the information that you provide and the information we collect automatically about your use of the OMSWLI Sites to monitor user traffic patterns and preferences for site improvement, analytics, and optimization.

EU – Legal Basis for Processing
Under European data protection laws, OMSWLI must have a legal basis to process your Personal Data. The legal basis that applies in an instance will depend on for which of the specific purposes described above OMSWLI is processing your Personal Data:

  • In certain cases, OMSWLI may ask for your consent to collect and process your Personal Data. Should you choose to provide your consent, you may later withdraw your consent by contacting us as described in the “Your Privacy Choices” section. Please note that the withdrawal of consent will not affect processing which has already occurred.
  • In other instances, the processing of your Personal Data may be necessary in order to comply with an applicable law or regulation or for the performance of a contract to which you are subject. You may not be able to opt-out of this processing, or your choice to opt-out may impact our ability to perform a contractual obligation otherwise owed to you.
  • In still other instances, OMSWLI may process your Personal Data based on OMSWLI’s legitimate interests in communicating with you about our services, and about scientific research and educational opportunities. You have the right to opt-out of all such processing of your Personal Data. You may do so by contacting us as described in the “Your Privacy Choices” section.

Information We Share
We only share your Personal Data with third parties as described below. We do not sell or rent Personal Data to third parties for their own marketing purposes or for any other reason.

Third-Party Advertising and Online Behavioral Advertising
You may be provided with online advertisements of OMSWLI events and services on third-party websites and mobile services that are tailored to you, for example, on the basis of information that you provide to OMSWLI or a third-party website you are visiting, or of your browsing activity, purchases, or interests. These types of tailored online advertisements may come through several sources, such as the following:

  • We may share with our advertising service providers your non-identifying information that we have obtained from cookies and other tracking technologies on the OMSWLI Sites.
  • OMSWLI may participate in online behavioral advertising (this is also sometimes called re-target advertising or interest-based advertising). Our advertising network partners may place and use cookies on the OMSWLI Sites and on other third-party websites to collect information about your activities in order to provide you with online advertisements that are based on your interests. When an OMSWLI online behavioral advertisement is delivered to you, you will see an “Ad Choices” icon. Clicking on the icon or link will take you to a website where you can manage or opt out of the use of data about your browsing history that is used for the delivery of online behavioral advertisements. If you opt out, you may still see advertisements online, including advertisements from OMSWLI that are based on other information (e.g., based on the content of the page being viewed rather than your prior clickstream activity). In some cases, data may still be collected about your browsing activity by these third-party advertisers, but they will not use this data to deliver advertisements that are based on your past online browsing behavior.   • Some web browsers may transmit “do-not-track” signals to websites with which the browser communicates. As of the Effective Date of this Privacy Policy, an industry standard has not yet been established on how to respond to these signals. Therefore, OMSWLI does not currently respond to these signals. As discussed above, you can opt out from advertisers that use your browsing history to deliver online behavioral advertisements by visiting adchoices.

Related companies, Vendors and Suppliers
We have relationships with suppliers and related companies, who help us operate our business and for whom it may be necessary to have access to your Personal Data in the course of providing services to OMSWLI. We will not authorize these parties to use your Personal Data for any purpose that is not related to OMSWLI and its related companies’ business operation, and we do not share Personal Data from countries that require consent, unless appropriate consent has been obtained in advance to sharing with related companies. We require them to handle your Personal Data collected in accordance with this Privacy Policy.

Co-branded Sites
We may partner with other companies to provide you with content or services on a joint or “co-branded” basis. At a co-branded site, you will see both the OMSWLI logo and the logo of the co-branding partner displayed on your screen. You should read the individual privacy policies of our co-branding partners, as they may differ in some respects from ours. Reading these policies will help you to make an informed decision about whether to provide your information to a given site.

Product Reports
If you contact OMSWLI regarding your experience in using one of our services, we may use the information that you provide in submitting reports to the designated government regulatory authority, as required of us by law.

Legal Rights and Obligations
In certain limited circumstances, OMSWLI may need to disclose your Personal Data in order to comply with a legal obligation or demand, such as to comply with reporting obligations to our governing regulatory authorities. In such instances, we will take measures to protect your Personal Data to the extent possible. We also reserve the right to use Personal Data to investigate and prosecute users who violate our rules or who engage in behavior that is illegal or harmful to others or to others’ property.

Children Privacy
OMSWLI does not knowingly collect or use any Personal Data directly from children on the OMSWLI Sites (We define “children” as minors younger than 18). We do not knowingly allow children to use our services, to communicate with us, or to use any of our online services. If you are a parent and become aware that your child has provided us with information, please contact us using one of the methods specified below, and we will work with you to address this issue.

Your Privacy Choices
You have the right to see and get a copy of Personal Data about you that we maintain as well as to ask us to make corrections to inaccurate or incomplete Personal Data about you. You may have the right to receive data you have provided to us in a machine-readable format and to transmit that data to another controller. You may also request the erasure of your Personal Data or the restriction of its processing, or object to the processing of Personal Data about you. For more information about your privacy rights, or if you are not able to resolve a problem directly with us and wish to make a complaint, please contact your local Data Protection Authority.

In all communications to OMSWLI, please include your email address, the website address, mobile application, and/or the specific OMSWLI service to which you provided Personal Data, and a detailed explanation of your request. If you would like to delete, amend, or correct your Personal Data and are contacting us by email, please put “Deletion Request” or “Amendment/Correction Request” in the subject line of the email. We will respond to all reasonable requests in a timely manner and may need to further confirm your identity in order to process certain requests.

Data Security
OMSWLI maintains reasonable technical, administrative, and physical controls to secure any Personal Data collected through the OMSWLI Sites. There is always some risk, however, that an unauthorized third party could intercept an Internet transmission, or that someone will find a way to thwart our security systems. We urge you to exercise caution when transmitting Personal Data over the Internet, especially your financial-related information. OMSWLI cannot guarantee that unauthorized third parties will not gain access to your Personal Data; therefore, when submitting Personal Data to the OMSWLI Sites, you must weigh both the benefits and the risks.

Third Party Sites and Social Media Plug-ins
This Privacy Policy does not apply to OMSWLI Sites that do not link to this Privacy Policy, or to third-party websites to which OMSWLI Sites may link. The OMSWLI Sites may use social media plug-ins (e.g., the Facebook “Like” button, “Share to Twitter” button) to enable you to easily share information with others. When you visit the OMSWLI Sites, the operator of the social plug-in can place a cookie on your computer or other electronic device that enables that operator to recognize individuals who have previously visited our Site. If you are logged into the social media website (e.g., Instagram, Facebook, Twitter) while browsing on our OMSWLI Site, the social media plug-in allows that social media website to receive information that you have visited the OMSWLI Sites. The social media plug-in also allows the social media website to share information about your activities on the OMSWLI Sites with other users of their social media website. These sharing settings are managed by the social media website and governed by its privacy policy.

Accessing Our Sites Globally
This site is owned and operated by OMSWLI in the United States, but the information you provide will be accessible to our vendors and suppliers in other countries in accordance with this policy. Furthermore, if you are visiting the OMSWLI Sites from a country other than the United States, your communication with us will necessarily result in the transfer of information across international borders. The level of legal protection for Personal Data is not the same in all countries; however, we will take the security measures described in this Privacy Policy in an effort to keep your information secure. By using the OMSWLI Sites, you understand that your Personal Data will be stored and processed in the United States and in any country to which we may transfer your information in the course of our business operations.

Notice to California Residents
Subject to certain limits under California Civil Code § 1798.83, California residents may ask us to provide them with (i) a list of certain categories of Personal Data that we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year, and (ii) the identity of those third parties. Changes to Our Privacy Policy
We will only use Personal Data in the manner described in this Privacy Policy in effect when the information was collected from you or as authorized by you. Subject to any applicable consent requirements, we reserve the right to change the terms of this Privacy Policy at any time. Any changes to this Privacy Policy will be reflected on this page with a new effective date. OMSWLI encourages you to review this Privacy Policy regularly for any changes. Terms of Participation

TERMS OF PARTICIPATION WITH OMS Women’s Leadership Initiative

  1. General
    OMSWLI has created an internet platform (the “Platform”), which offers, among other things, educational and scientific materials, information about activities of OMSWLI and the scholarly community, and access to open-source publications related to regenerative medicine and original OMSWLI content (e.g., white papers). Access to the Platform content is available to any visitor of the OMSWLI website by creating a free account and logging in using a unique user name and password.
  2. Privacy Policy and Terms of Use of the Platform
    Any user of the OMSWLI Platform must comply with the Privacy Policyand the Terms of Use of OMSWLI’s Platform, whenever they use such Platform.
  3. Data protection
    Users must provide OMSWLI with required personal data, including their first and last name, email address, country where they are located, professional specialty, and birthdate. Additionally, users may also provide biographical information that identifies them (“Personal Data”). OMSWLI uses the Personal Data in order to create the account, to communicate with the user, and more generally to provide users with services available through the Platform. OMSWLI will store and process such Personal Data in accordance with the Platform’s Privacy Policy. OMSWLI must collect and use such Personal Data in order to register users and grant access to the full features of the Platform. OMSWLI implements all appropriate technical and organizational measures to protect Personal Data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure, or access for third parties and against other unlawful forms of processing. These measures will also be implemented by any processor of Personal Data authorized by OMSWLI in accordance with the Platform’s Privacy Policy. Users have the right to access and rectify at any time their Personal Data collected by OMSWLI or request their deletion by emailing info@OMSWLI.org.
  4. Termination or Exclusion
    Any user may terminate his or her participation at any time, with or without cause, via written notice to OMSWLI (info@OMSWLI.org). Upon termination, all Personal Data will be deleted from our servers. In addition, OMSWLI may withdraw the user’s access to the Platform if such a participant has acted materially against the interests or principles of OMSWLI or has behaved inappropriately in a similar way. OMSWLI reserves the right to exclude immediately and permanently any user from the Platform without notice in case of breach of the Terms of Use, the Privacy Policyor these Terms of Participation. OMSWLI also reserves the rights to terminate the participation of a user if the conditions of access to the status are not met anymore.

Terms of Use

OMS Women’s Leadership Initiative WEB PLATFORM: TERMS OF USE

    1. General

    1.1 Welcome to the Web platform of OMS Women’s Leadership Initiative. If you choose to use www.omswli.org (the “Platform”), or OMSWLI’s mobile sites and applications, (collectively, the “OMSWLI Application”), you accept to abide by all the terms and conditions of these terms of use (“Terms of Use”) and any other terms which are incorporated herein by reference, including, but not limited to, the Privacy Policy; if you do not agree, please do not use this Platform or the OMSWLI Application.

    1.2 Please review the Terms of Use carefully. OMSWLI may update the Terms of Use at any time without notice to you. The most current version of the Terms of Use can be reviewed by clicking on the “Terms of Use” hypertext link located at the bottom of the Platform and is also available through the OMSWLI Application. It is your responsibility to review these Terms of Use prior to each use of the Platform and the OMSWLI Application; by continuing to use this Platform or the OMSWLI Application, you agree to any changes.

    1.3 OMSWLI may change, suspend, or discontinue any aspect of the Platform or the OMSWLI Application at any time, including the availability of any feature, database, or content. OMSWLI may also impose limits on certain features and services or restrict your access to parts or all of the Platform and the OMSWLI Application without notice or liability.

    1.4 This Platform and the OMSWLI Application are accessible to every visitor; however, access to certain features and certain content of the Platform is restricted to registered users (“User(s)”). To learn more about how to become a User please consult the Terms of Participation. Unless specifically indicated otherwise, these Terms of Use shall apply to all Users.

    1. OMSWLI Content

    2.1. All materials published on the Platform or on the OMSWLI Application (including, but not limited to articles, checklists, pictures, images, illustrations, audio clips, and video clips, together the “Content”) are protected by copyright, and owned, controlled by, or duly licensed to OMSWLI and/or the party credited as the provider of the Content. You shall abide by all copyright notices, information, or restrictions contained in any Content accessed through the Platform or through the OMSWLI Application.

    2.2. You may not modify, publish, transmit, participate in the transfer or sale of, use, reproduce (except as provided in Clause 2.3 of these Terms of Use), create new works from, distribute, perform, display, or in any way exploit, any of the Content in whole or in part.

    2.3. You may access certain downloadable items that are displayed on the Platform and on the OMSWLI Application, such as, but not limited to, open-sourced articles and OMSWLI -produced white papers. These items can be downloaded, exported, and/or copied for personal use and for use solely in your own professional practice. The transfer, display, sale, or other use of these items for any other purpose is strictly prohibited.

    2.4. All Content (white papers, webinars, challenge cases, checklists, e-books, treatment guidelines, etc.) provided to you on the Platform and on the OMSWLI Application are for information purposes only. They are intended for use by professionals and trained clinicians, to guide them through the key steps of or to explain a given procedure. They can be used as an additional tool by the professionals but shall not substitute appropriate verification.

    Neither OMSWLI nor any person related to it, in particular the clinician who authored the white paper, webinar, challenge case, checklist, e-book, or treatment guideline, makes any representation or warranty, whether express or implied, including, but not limited to, warranty of fitness for a particular purpose, nor assumes any liability for the accuracy or completeness of the information provided in these items.

    Furthermore, if you download and/or use the Platform, the OMSWLI Application or any Content, you ensure and assume all responsibility that these terms have been read, understood, and accepted by you and any person, colleague, or other professional, who will download and/use the Platform, the OMSWLI Application and this Content through your tablet, computer, or Account.

    1. User Generated Content

    3.1 Users may be able to upload Content on this Platform, and may also be able to post comments in dedicated sections of this Platform. They shall not upload to, distribute, or otherwise publish on to the Platform any libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal material.

    When uploading Content, it is the User’s responsibility to comply with all applicable privacy regulations and applicable laws. It is the User’s sole responsibility to act in full accordance with all laws, in particular laws relating to patient data protection.

    Users may have the option to post comments in an anonymized way. Please note, however, that the Platform administrators will be able to know which User has posted a specific comment.

    3.2. You agree that you will not threaten or verbally abuse other Users, use defamatory language, or deliberately disrupt discussions with “spam.” Furthermore, you shall not use defamatory, discriminatory, or otherwise abusive language against OMSWLI or against any natural or legal person, this person being a User or not. Any such behavior or other noncompliance to the obligations set out herein can result in immediate and permanent ban from OMSWLI and suspension of access to the sections of the Platform dedicated to Fellows. Exclusions rules are set out below in Clause 5.

    3.3 The Platform and the OMSWLI Application shall be used in accordance with the scientific, educational, and humanitarian purposes of OMSWLI , e.g., for the exchange of scholarly works and for the exchange of peer advice of specific cases, and under no circumstances in a commercial manner. You shall not, without the express approval of OMSWLI , distribute or otherwise publish any material containing any solicitation of funds, free advertising, or solicitation for goods or services. For the avoidance of doubt, you may make mention of the type or brand of products used for a specific patient case, but under no circumstances shall you make reference or mention a product for advertising purposes.

    3.4 You acknowledge that any submissions you make to the Platform (e.g., user-generated content, including but not limited to, comments, forum messages, reviews, text, video, audio, and photographs) (each, a “Submission”) may be edited, removed, modified, published, transmitted, and displayed by OMSWLI , and you waive any rights you may have in having the material altered or changed in a manner not agreeable to you. Submissions made to the Platform may also be made available for republishing through other formats, e.g., through the OMSWLI Application.

    3.5 Unless otherwise expressly agreed in writing by OMSWLI, you grant OMSWLI a perpetual, nonexclusive, worldwide, royalty-free, sub-licensable license to the Submissions, which includes without limitation the right for OMSWLI or any third party it designates, to use, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, create derivative works of, host, index, cache, tag, encode, modify, and adapt (including without limitation the right to adapt to streaming, downloading, broadcast, mobile, digital, thumbnail, scanning, or other technologies) in any form or media now known or hereinafter developed, any Submission posted by you on or to the Platform, including any Submission posted on or to the Platform through a third party.

    3.6 You are solely responsible for the content of your Submissions you upload on the Platform. Furthermore, you are solely responsible for collecting all relevant consents before uploading Content on the Platform, such as, but not limited to, the patient’s consent or the copyright owner’s consent.

    3.7 Submissions may be reviewed and edited before display on the Platform as described in 3.8 below. The review shall be made by OMSWLI or the persons it designates, to the exception of comments which can also be reviewed and accepted or rejected by the User who uploaded the Submission receiving the comment. Under no circumstances shall OMSWLI be responsible for the Submission or for any comment, nor can it be held responsible should a Submission or comment not be displayed on the Platform.

    3.8 OMSWLI reserves the right to not display, or to delete, move, or edit Submissions that OMSWLI , in its sole discretion, deems abusive, defamatory, obscene, inappropriate, in violation of copyright or trademark laws, or otherwise unacceptable.

    3.9 By making a Submission, you are consenting to its display and publication on the Platform and on the OMSWLI Application and for related online and offline promotional uses.

    1. Representations and Warranties

    4.1 The views expressed on the Platform by a User or author reflect only the opinion of that User or author, and OMSWLI does not make any representation or warranty as to what is expressed by Users or authors on the Platform. Additionally, the views posted and the Submissions of the Users or authors cannot replace a medical advice, and shall under no circumstances be construed or used as or in lieu of an appropriate medical assessment.

    4.2 OMSWLI does not make any representation or warranty with regard to hyperlinks to third-party websites, which are totally beyond the control of OMSWLI .

    4.3 You represent and warrant that no materials of any kind submitted through your account will (i) violate or infringe upon the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights, or (ii) contain libelous or otherwise unlawful material.

    4.4 You hereby undertake to indemnify, defend, and hold harmless OMSWLI and any person related to OMSWLI , including, but not limited to, the persons acting as Directors and/or Officers, from and against any and all liability and costs, including, without limitation, reasonable attorneys’ fees, incurred by OMSWLI or the related persons in connection with any claim arising out of any breach by you or any user of your account of these Terms of Use or the foregoing representations and warranties.

    4.5 OMSWLI does not warrant or endorse the accuracy or reliability of any Content, advice, opinion, statement, or other information displayed, uploaded, or distributed through the Platform or the OMSWLI Application by any User, information provider, or any other person or entity. You acknowledge that any reliance upon any such Content, opinion, advice, statement, memorandum, or information shall be at your sole risk. The services and all exportable or downloadable items are distributed on an “as is” basis without warranties of any kind, either express or implied, including, without limitation, warranties of fitness for a particular purpose. You hereby acknowledge that use of the Platform, OMSWLI Application, and any Content herein displayed, is at your sole risk.

    1. Registration, Termination and Exclusion from the Platform

    5.1 As part of the registration as a User on this Platform, you will set up an account (the “Account”) by creating login credentials, selecting a password, and providing an e-mail address. You also have to give us certain registration information, such as your first and last name, all of which must be accurate and updated. Your Personal Data will be processed in accordance with the Privacy Policy of OMSWLI .

    5.2 You agree that you will provide complete, current, and accurate information about yourself as requested, and that you will keep that information up to date. You are responsible for safeguarding the confidentiality of your username and password, which are used to access the Platform. You agree not to disclose your username or password to any third party. You agree that you are solely and fully responsible for any activities or actions taken under your Account, whether or not you have authorized such activities or actions. You will immediately notify OMSWLI of any unauthorized use of your Account.

    5.3 A User may terminate their access to the Platform and to their Account at any time, with or without cause. Upon termination, the User’s right to access the dedicated sections of the Platform will immediately cease. Upon termination, the User will have no further access to any information, files, or materials related to their Account. OMSWLI shall have no liability whatsoever to any User or any third party as a result of a termination of the User’s rights of access to their Account.

    5.4 OMSWLI reserves the right to exclude immediately and permanently any User from the dedicated sections of the Platform without notice in case of breach of these Terms of Use, the Privacy Policy or any other terms which are incorporated herein by reference. Further information about the conditions to become a Fellow and the terms applying to the Fellow status is available in the Terms of Participation.

    1. Communication between OMSWLI and Users

    OMSWLI may send emails to you for the purpose of informing you of changes or additions to the Platform or the OMSWLI Application, as well as of informing you about OMSWLI-related events and news. If you do not wish to receive such communication, please click on “unsubscribe” at the bottom of the email communication or write to info@osetoscience.org. For more information about the use and treatment of your data, including, but not limited to, your email address, please consult the Privacy Policy.

    1. Intellectual Property

    7.1 All intellectual property rights in the Platform and the OMSWLI Application are and shall remain the exclusive property of OMSWLI or its licensors, as applicable, unless expressly indicated otherwise.

    7.2 This Platform, the OMSWLI Application, and the information contained and referenced therein are copyright protected. Any copy, reproduction, republication, upload, translation, retransmission, or other use is strictly prohibited. Request for permission to reproduce any information contained on this Platform and on the OMSWLI Application should be addressed to OMSWLI, using the email address indicated below in Clause 9.2.

EACH USER IS RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF HIS OR HER OWN PASSWORD.

    9.1 These Terms of Use shall be governed by and construed in accordance with the substantive laws of the United States of America. The place of jurisdiction for all disputes arising out of your use of the Platform or the OMSWLI Application shall be the place of establishment of OMSWLI.
